Terms of Service

Welcome to Livify! These Terms of Service (“Terms”) govern your access to and use of the Livify mobile application and any related services (collectively, the “Service”). By signing up for an account or by otherwise accessing or using Livify, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

By signing up, you agree to our Terms of Service and Privacy Policy.

These Terms form a legally binding agreement between you (“User” or “you”) and ASH PRODUCTION DESIGNS LTD (“ASH PRODUCTION DESIGNS LTD,” “we,” “us,” or “the Developer”), the company that develops and operates Livify. Please read them carefully.

Important Disclaimers

Livify is a personal wellness, habit tracking, and budgeting tool. It is not medical, legal, or financial advice. Any information or insights provided by Livify (such as trend analyses or suggested habits) are for informational purposes only and are not a substitute for professional advice. Always consult a qualified healthcare provider for medical questions, a licensed financial advisor for financial decisions, or a legal professional for legal matters. Use of Livify is at your own risk. We make no guarantee of specific outcomes (health, financial, or otherwise) from using the app, and we disclaim liability for decisions you make based on information provided.

1. Eligibility and Account Registration

1.1 Eligibility

You must be at least 13 years old to use Livify. We do not permit use of the Service by individuals under 13. If you are 13 or older but under the age of majority in your jurisdiction, you must have your parent or legal guardian’s permission to use Livify, and they must review these Terms with you. By using the Service, you represent and warrant that you meet the applicable age requirements and are otherwise legally qualified to enter into this agreement. If you do not, you must not use Livify. We reserve the right to ask for proof of age or permission at any stage.

1.2 Account Creation

To access certain features, you may need to create a user account. When registering, you agree to provide true, accurate, current, and complete information about yourself as prompted by the registration flow. You agree to update your information promptly if it changes. You must not impersonate someone else or create an account using someone else’s information or a false identity.

1.3 Account Security

You are responsible for maintaining the confidentiality of your account login credentials. Use a strong, unique password and safeguard it. Do not share your account or password with anyone. You agree to notify us immediately at support@livifyapp.co if you suspect any unauthorized access to or use of your account. You understand you are responsible for activity that occurs under your account until you notify us of unauthorized use. We will not be liable for any loss or damage arising from your failure to keep your credentials confidential.

1.4 One Account Per User

You should create only one account for your personal use. Creating multiple accounts without permission, especially for disruptive or abusive purposes, is prohibited. You also must not create an account if we previously terminated your account for violation of these Terms unless you have our written permission to return.

1.5 Profile and Communications

By creating an account, you consent to receive electronic communications from us (via the app, email, or other means) regarding your account and the Service (e.g., verification messages, receipts, legal notices, or support responses). These communications are part of the Service and you may not be able to opt out of them (except those that are marketing in nature, which you can opt out of separately). 2. User Responsibilities and Acceptable Use

When using Livify, you agree to abide by these rules and not to misuse the Service. You are responsible for your actions on Livify and for any content or data you input.

2.1 Permitted Use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Livify for your own personal, non-commercial purposes, and only as permitted by these Terms and the App Store Usage Rules. This license is provided by us (ASH PRODUCTION DESIGNS LTD), not by Apple. You may only install and use Livify on Apple devices that you own or control, and as allowed by Apple’s App Store terms. We remain the owner of Livify and all related content; you are not buying the app, only receiving permission to use it.

2.2 Prohibited Activities

You agree not to:

  • Use Livify for any unlawful, harmful, or fraudulent purpose.
  • Attempt to gain unauthorized access to the Service or related systems (including hacking or bypassing security).
  • Introduce malware, viruses, or harmful code, or disrupt the Service or networks.
  • Harvest, scrape, or extract data from the app without our written consent.
  • Reverse engineer, decompile, or disassemble the app except to the limited extent allowed by law.
  • Input content that infringes third-party rights or is defamatory, obscene, or unlawful.
  • Exploit Livify commercially or use it to provide services to third parties without permission.
  • Use Livify to build or benchmark a competing product or service.
  • Engage in unauthorized sharing or misuse of features (including future sharing/community features if introduced).

Violation of these rules may result in suspension or termination of your account and may subject you to legal consequences. We reserve the right to investigate suspected breaches and cooperate with law enforcement where required.

2.3 Your Data and Content

The data you input into Livify (habit logs, wellness information, budget entries, etc.) remains your property. We claim no ownership over your raw personal information. However, by using the Service, you grant us a license to use, process, and display that data as needed to operate the Service and as otherwise permitted by our Privacy Policy (for example, to back it up, to display it to you, or to analyze usage trends in aggregate). This license is worldwide, royalty-free, and limited to providing and improving the Service. You remain responsible for ensuring that any data you provide does not violate laws or third-party rights. You may request deletion of your data as described in our Privacy Policy.

2.4 User Feedback

If you provide suggestions, ideas, or other feedback (“Feedback”), you agree we can use and share such Feedback for any purpose without compensating you. You grant us a worldwide, perpetual, irrevocable, sublicensable license to use and incorporate Feedback into our products or services.

3. Ownership and Intellectual Property

3.1 Our Intellectual Property

Livify (including software, design elements, logos, and trademarks) is owned by ASH PRODUCTION DESIGNS LTD and is protected by intellectual property laws. These Terms do not grant you any ownership rights. You may not use the ASH PRODUCTION DESIGNS LTD name, the Livify name, or any trademarks without our prior written consent, except to make truthful references to the Service.

3.2 Content on the Service

Aside from the data you input (which remains yours), all other content made available through the Service is our property or the property of our licensors. You agree not to copy, distribute, modify, or create derivative works of any part of the Service except as expressly permitted by us.

3.3 Respect for Third-Party Rights

We respect the intellectual property rights of others and expect you to do the same. If you believe content in the Service infringes your rights, contact us with “IP Infringement” in the subject line at support@livifyapp.co and include the relevant details.

3.4 Third-Party Software and Libraries

Livify may incorporate open-source software or third-party libraries. Those components are subject to their own licenses, and you agree to comply with those licenses.

4. Subscriptions, Purchases, and Payments

Livify is free to download and includes free features. We may also offer premium features through in-app purchases or subscriptions (“Premium Subscription”). Purchases are processed through Apple’s App Store using your Apple ID, and Apple’s payment terms apply. We do not receive your payment information directly.

4.1 In-App Purchases via Apple

Prices and terms will be shown in-app at the time of purchase, including applicable taxes.

4.2 Subscription Terms

Subscriptions typically auto-renew unless you cancel. Free trials (if offered) may convert to paid subscriptions unless canceled before the trial ends. You can manage or cancel subscriptions through Apple’s subscription management (Settings → Apple ID → Subscriptions → Livify). We cannot cancel App Store subscriptions on your behalf. If Apple changes subscription pricing, Apple may notify you and require consent.

4.3 Refunds

Refunds and billing disputes must be directed to Apple via their “Report a Problem” process or Apple Support, as Apple processes all payments. We do not have the ability to issue App Store refunds directly.

4.4 Failure to Pay

If a subscription charge is not successfully processed, Apple may cancel your subscription. You are responsible for keeping your Apple payment information current.

4.5 Promotions

Promotional codes or discounts may be offered from time to time and are subject to specific terms. Promotions are non-transferable and not redeemable for cash.

4.6 No Circumvention

You agree not to circumvent the payment system or access paid features without paying applicable fees. Unauthorized access to paid features is a violation of these Terms and may result in termination.

5. Maintenance, Support, and Modifications

5.1 Developer Responsibility

ASH PRODUCTION DESIGNS LTD is solely responsible for providing maintenance and support for Livify. Apple has no obligation to furnish maintenance or support services. For support, contact support@livifyapp.co.

5.2 Updates and Feature Changes

We may release updates, bug fixes, or feature changes. You consent to receive updates as part of using the Service. The Service (or any part of it) may be modified or discontinued without notice, though we may provide notice for significant changes when feasible.

5.3 Availability

We aim to keep Livify available, but we do not guarantee uninterrupted access. We are not liable for downtime or service interruptions.

5.4 Support Limits

Support is provided via email and may also be offered through in-app help pages. We do not guarantee response times. Support is generally provided in English and on an “as available” basis.

5.5 Your Responsibilities for Updates

You are responsible for keeping your device operating system updated and using a compatible device. We recommend using the latest iOS version.

6. Third-Party Services and Content

Livify integrates with third-party services (such as Supabase and RevenueCat) and uses Apple’s App Store purchase system. Your use of those services may be subject to their terms. We are not responsible for third-party content or external sites linked from the Service.

7. Disclaimers of Warranty

Livify is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that results will be accurate or meet your expectations.

Livify is not a medical, legal, or financial advisor. Any information provided is for general informational purposes only. Use of the Service is at your own risk.

Apple has no warranty obligation with respect to Livify. If the app fails to conform to any applicable warranty and you notify Apple, Apple’s sole obligation is to refund the purchase price (if any), to the maximum extent permitted by law.

8. Limitation of Liability

To the fullest extent permitted by law, ASH PRODUCTION DESIGNS LTD will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of the Service.

To the extent we are found liable notwithstanding the above, our aggregate liability for all claims related to the Service in the twelve (12) months preceding the event giving rise to liability will not exceed the amount you paid for the Service in that period, or £50, whichever is greater. If you paid nothing, liability is capped at £50. Nothing in these Terms limits or excludes liability that cannot be excluded by law (including death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation).

9. Indemnification

You agree to indemnify and hold harmless ASH PRODUCTION DESIGNS LTD and its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your violation of these Terms, your data/content, or your misuse of the Service.

10. Termination and Suspension

You may stop using Livify at any time. We may suspend or terminate access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, your license ends and you must stop using the Service. Certain provisions (including IP, disclaimers, limitation of liability, and indemnification) survive termination.

11. Governing Law

These Terms are governed by the laws of England and Wales. If you are a consumer residing outside England and Wales, you may have mandatory consumer rights under local law that remain unaffected.

12. Dispute Resolution

If you have a concern or dispute, please contact us first so we can try to resolve it informally at support@livifyapp.co. Subject to mandatory consumer protection laws, UK consumers may bring claims in the courts of England and Wales, and consumers in the EU/other jurisdictions may also bring proceedings in their country of residence where required by law. You may have the right to use an alternative dispute resolution (ADR) provider.

13. Apple App Store Additional Terms (Third-Party Beneficiary)

You acknowledge these Terms are an agreement between you and ASH PRODUCTION DESIGNS LTD, not Apple. Apple is not responsible for the Service’s content, maintenance, support, or performance. Apple (and its subsidiaries) are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary.
